1. Introduction
Welcome to Eyer Performance.
These Terms of Service govern your use of our online store and the purchase of products offered through it.
Eyer Performance is a sports technology retailer operated by Tsvetan Tsankov as an individual seller conducting commercial activities.

By placing an order, you agree to these Terms of Service. Nothing in these Terms limits your mandatory rights under applicable consumer protection legislation.
2. Products and Availability
Eyer Performance offers sports technology products, including wearable devices, performance monitoring systems, training equipment and related accessories.
We make reasonable efforts to ensure that product descriptions, specifications, images and prices are accurate.
Product availability may depend on third-party suppliers and distribution partners.
If a product becomes unavailable after an order has been placed, we will contact you promptly to offer an appropriate alternative, a revised delivery arrangement or a refund.
We will not substitute a product without your agreement.
3. Orders and Contract Formation
Customers can place orders through our online store.
Before submitting an order, customers can review their selected products, quantities, delivery information and total price.
Submitting an order constitutes an offer to purchase the selected products.
An automated order acknowledgement confirms receipt of the order but does not necessarily constitute acceptance.
We review orders manually. A contract is formed when we expressly confirm acceptance of the order, unless mandatory applicable law provides otherwise.
If we cannot accept an order, we will inform the customer and refund any payment collected without undue delay.
4. Prices and Payment
All product prices are displayed in the currency shown at checkout.
The final amount payable, including applicable taxes and delivery charges, is displayed before the order is submitted.
Payment is collected at checkout through the payment methods made available by Eyer Performance.
Payments are processed through secure third-party payment providers, including Shopify Payments where applicable.
We do not intentionally store complete payment card details on our own systems.
We reserve the right to correct pricing errors. If an error affects an order already submitted, we will contact the customer before proceeding. We will not charge an increased price without the customer's agreement.
5. Shipping and Delivery
Eyer Performance currently offers delivery to supported destinations within the European Union.
Standard shipping is provided free of charge where indicated at checkout.
Orders are normally prepared for dispatch within approximately five business days, subject to product availability and supplier arrangements.
This processing estimate is not a guaranteed delivery date.
Products may be dispatched from our own fulfillment location or directly from authorized suppliers and distribution partners.
Orders containing multiple products may arrive in separate shipments.
Delivery estimates, where available, will be communicated before purchase or during order processing.
We remain responsible for fulfilling our obligations to customers regardless of whether shipping is performed by Eyer Performance or a third-party supplier.
Unless a different delivery period is expressly agreed, goods will be delivered within the period required by applicable consumer law.
If delivery cannot be completed within the agreed or legally applicable timeframe, customers retain their statutory rights.
6. Order Cancellations
Customers may request cancellation of an order before fulfillment by contacting eyer.performance@gmail.com.
Cancellation requests will be reviewed according to the order's processing and shipping status.
Where an order is cancelled before dispatch, payments collected for the cancelled products will be refunded.
If the order has already been dispatched, the applicable return and withdrawal procedures will apply.
This section does not restrict any mandatory statutory right to cancel or withdraw from a purchase.
7. Returns and Right of Withdrawal
Consumers purchasing online generally have a statutory right to withdraw from a purchase within 14 calendar days after receiving the goods, subject to applicable legal exceptions.
For orders delivered in multiple shipments, the withdrawal period generally begins when the final item is received.
Customers may exercise their right of withdrawal by sending a clear statement to eyer.performance@gmail.com.
We will provide the appropriate return instructions and address for the order.
For ordinary withdrawal returns, customers are responsible for direct return shipping costs, where this was properly disclosed before purchase.
No restocking fee is charged for exercising the statutory right of withdrawal.
Refunds are handled in accordance with applicable law and our Return and Refund Policy.
8. Defective Products and Legal Guarantees
Products sold to consumers are covered by applicable statutory guarantees of conformity.
Under European Union consumer protection rules, consumers generally benefit from a minimum two-year legal guarantee for goods.
If a product is defective, damaged or does not conform to the contract, customers should contact Eyer Performance.
Depending on the circumstances and applicable law, customers may be entitled to repair, replacement, a price reduction or a refund.
Any manufacturer's commercial warranty is additional to, and does not replace, statutory consumer rights.
9. Product Use and Safety
Customers should use products in accordance with the manufacturer's instructions, safety warnings and intended purpose.
Performance monitoring devices and related technologies may provide estimates or measurements that depend on usage conditions, calibration and individual characteristics.
Unless expressly identified as certified medical devices for a particular purpose, products should not be relied upon for medical diagnosis or treatment.
Nothing in this section excludes liability for defective or unsafe products where such liability cannot lawfully be excluded.
10. Intellectual Property
The Eyer Performance name, original website content, branding and other proprietary materials may not be reproduced or commercially exploited without appropriate authorization.
Third-party trademarks, product names, logos and images remain the property of their respective owners.
11. Website Use
Customers agree not to use the website for unlawful purposes, fraudulent transactions or activities that interfere with its security or operation.
We may take reasonable measures to prevent fraudulent orders and misuse of the website, while respecting applicable law and consumer rights.
12. Privacy and Personal Data
Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation.
We use customer information to process orders, arrange delivery, communicate with customers and fulfill applicable legal obligations.

13. Liability
Eyer Performance is responsible for its obligations under applicable law.
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including mandatory consumer rights and liability for defective products.
We are not responsible for interruptions caused by circumstances beyond our reasonable control, except where applicable law provides otherwise.
14. Governing Law and Disputes
These Terms are governed by Bulgarian law, without prejudice to mandatory consumer protection provisions applicable in the customer's country of habitual residence.
Nothing in these Terms deprives consumers of mandatory protections or jurisdictional rights available under applicable European Union law.

Information about applicable consumer dispute resolution bodies and procedures will be provided where required by law.
15. Changes to These Terms
We may update these Terms to reflect changes in our operations, products or applicable legal requirements.
The version applicable to a purchase is generally the version made available when the order was placed, unless otherwise required by law or agreed with the customer.
